Arizona 5-Day Notice to Pay Rent or Quit (ARS § 33-1368)

Under Arizona Revised Statutes § 33-1368, a landlord must give a tenant a written 5-day notice to pay rent before filing a special detainer action for non-payment. Arizona counts calendar days — weekends are included — but if Day 5 falls on a Sunday or legal holiday, the deadline extends to the next business day.

What the Notice Must Include

  • Tenant's full name(s)
  • Property address
  • Exact amount of rent owed
  • Period covered by the unpaid rent
  • A demand to pay within 5 days or vacate
  • Landlord's name and address for payment

How to Count 5 Days in Arizona

Arizona counts calendar days. Serve on Monday = Day 5 is Saturday. If Day 5 is a weekend or legal holiday, deadline moves to the next business day.

Late Fees in Arizona Notices

Unlike California, Arizona does not expressly prohibit including late fees in the demand. However, best practice is to demand only base rent to avoid any argument over the total amount — keep the figure clean and unambiguous.

Service Methods

  1. Personal delivery to the tenant
  2. Leaving with someone of suitable age at the premises plus mailing a copy
  3. Posting on the door plus mailing a copy (if tenant is not home)

Repeat Non-Payment

If the tenant has failed to pay rent on time three or more times in the preceding 12 months, Arizona law allows you to serve a notice to terminate the tenancy without offering cure rights after the third occurrence. NoticeGen tracks this within a generation session.
