Florida requires 15 days written notice before the end of a monthly period to terminate a month-to-month tenancy under Fla. Stat. § 83.57. Florida has no statewide rent control and no just cause eviction requirement.
| Lease Type | Required Notice |
|---|---|
| Month-to-month | 15 days before end of monthly period |
| Week-to-week | 7 days |
| Quarter-to-quarter | 30 days |
| Year-to-year | 60 days |
The 15-day notice must be delivered before the beginning of the final rental period. For example, if rent is due on the 1st and you want the tenancy to end on June 30, you must serve the notice by May 16 at the latest (15 days before June 1).
Serving the notice too late means the termination date pushes to the next rental period.
Florida landlords can terminate a month-to-month tenancy for any lawful reason with proper written notice. No reason needs to be stated.
Not legal advice.
